Do I have to pay attorneys' fees?
The Arizona Lemon Law has a statutory fee-shifting provision which states that a manufacturer shall pay for a consumer’s attorneys’ fees if the consumer prevails. Pryor, Ramirez & Amar, LLC does not charge a consumer attorneys’ fees but rather takes cases on a contingency basis. For Fraud cases there maybe attorneys' fee charges. What other costs are there?
If it is required that a Complaint be filed in court, the filing fee is the responsibility of the client. There may also be other court costs associated with a case and there may be the need for an expert vehicle inspection. Please call for complete details.
Will I have to go to trial?
Not necessarily. There is often times an opportunity to settle a case short of a trial in front of a judge and a jury.
How much of my time will this take?
If there is no complaint filed, the case will take very little of your time. However, if a case is filed, the defendant will have the right to depose (question) you, which can take a day of your time. The defendant may also have the right to inspect your vehicle, which can also take about a day’s time. The actual time commitment will vary from case to case, but you need to be prepared to spend some time in order to stand up to the manufacturer.
Will I still be able to get warranty repairs during my case?
Yes, your warranty is still valid.
How much time do I have to file a case?
An action under the Arizona Lemon Law must be filed within 6 months of the earlier of 2 years or 24,000 miles.
Do all cases get filed?
No, you may have an opportunity to settle prior to the filing of a case. This depends on the manufacturer and your expectations. Please contact us for further information.
What do I do if I was sold a damaged vehicle by a dealer?
Run a Carfax, take the vehicle to an independent repair shop for an estimate, then contact Pryor, Ramirez & Amar, LLC.
Do I have any warranty if I buy a car used?
Yes, in Arizona cars cannot be sold “AS-IS” consumers have a statutory implied warranty for the earlier of 15 days or 500 miles.
Does any statute protect used car buyers?
Yes, they are protected A.R.S. §44-1267 which provides all consumers have a statutory implied warranty for the earlier of 15 days or 500 miles. Consumers are also protected under the Consumer Fraud Act. See our section on fraud for more information.
